The ruling of the government-controlled Constitutional Tribunal, issued at the request of the Prime Minister Mateusz Morawiecki, opens the next stage of the political and legal confrontation between the Polish government and the European Union. By questioning the primacy of European law and refusing to recognize the judgments of the EU Court of Justice with regard to the principle of the independence of the judiciary, Poland challenged the fundaments of the EU legal order. The verdict has also opened speculation as to whether the PiS-led government wishes Poland to remain a member of the EU for much longer.
The panel we will discuss the consequences of the judgment for Poland and for the European Union and ask experts whether Poland has actually entered the path of Polexit and what the EU should do to defend its legal space and protect the authority of the EU Court of Justice.
